INTRODUCTION

Plaintiff Bill Mihalitsas (“Plaintiff’) brings this action against Defendants Kenneth Howard (“Defendant Howard”) and “FNU” Dougherty (“Defendant Dougherty”) pursuant to 42 U.S.C. '§§ 1983 and 1985, alleging that Defendants violated his civil rights following his arrest on a vehicle and traffic violation on February 23, 2013. (Dkt. 1). On August 6, 2014, Defendants moved for partial dismissal of Plaintiffs claims under Fed.R.Civ.P: 12(b)(6). (Dkt. 3).
