The appellant, as receiver of an insolvent corporation, commenced this action for the purpose of recovering from the respondent bank certain payments which it is claimed had been received from the insolvent corporation, or had been taken from' the deposits of the insolvent corporation made with such bank, and which payments, it is claimed, constituted a preference under the trust fund doctrine as announced by this court in various cases which have been before us.
