ORR, Justice.

On 7 February 2000, an Edgecombe County grand jury indicted Parish Lorenzo Matthews for one count of first-degree murder, one count of larceny, and one count of financial transaction card theft. On 6 November 2000; defendant was further indicted for second-degree burglary and attempted second-degree rape.

On 21 May 2001, prior to the start of trial, defendant pled guilty to the larceny and financial transaction card theft charges. At the end of the evidence, the trial court dismissed the attempted second-degree rape charge. On 24 May 2001, the jury found defendant guilty of…
