The application for an order permitting the disbursement of funds now in the hands of the ancillary executor for the purpose of paying counsel fees in connection with the appeal by the ancillary executor from the judgment entered in the United States District Court for the Southern District of New York on April 7, 1939, and for the payment of the disbursements in connection with said appeal is denied.
