This is an action in ejectment, brought in the circuit court of Peoria county, concerning a narrow strip of land between the lines claimed by appellant and appellee, respectively, as the division line of the two adjoining lots owned by them, in the city of Peoria. Trial was had before the court, jury being waived, and resulted in a finding of not guilty. This judgment was set aside and a new trial allowed under section 35 of the Ejectment act.
