This is an appeal from a judgment of $114,714.80, rendered on the verdict of a jury against the City of Chicago and in favor of plaintiff, M. H. McGovern.

This action is grounded upon a contract entered into between the City of Chicago and M. H. McGovern Company, a corporation, for the repairing of asphalt pavements in the City of Chicago, and is dated June 1, 1908. The contract provides that work under it shall commence June 2, 1908, and be completed on or before the 1st day of July, 1909.
