Before the Court is Plaintiffs Motion for Leave to File a Second Amended Complaint [Docket No. 100], filed on November 8, 2010. Plaintiffs motion comes in response to this court’s September 22, 2010 order [Docket No. 99] dismissing the First Amended Complaint (“FAC”) without prejudice.
