— Judgment unanimously affirmed. Memorandum: Defendant was charged with attempted arson in the third degree (Penal Law §§ 110.00, 150.10 [1]) and criminal mischief in the third degree (Penal Law § 145.05) for *1013attempting to damage a parked automobile by starting a fire therein. He was convicted, following a jury trial, of attempted arson in the third degree and criminal mischief in the fourth degree.
