The subject-matter out of which this' appeal arises has twice been before this court. Certain land in Creek county was allotted to Robert Marshall, a minor Creek freedman. Sometime; abo'ut 1909, while a minor, Robert Marshall was married and thereafter a decree was entered in the district coturt of Creek county conferring majority rights upon him. He then, while under the age of 21 years, executed certain instruments purporting to convey a portion of said land and the oil and gas rights therein and an option to purchase, the remaining interest in said land.
