— On the 21th day of May, 1870, the commissioners of King county on behalf of the Territory of Washington selected the land now in controversy as lieu school land, under the act of Congress approved March 2, 1853, entitled, “An act to establish the territorial government of Washington Territory,” and the supplemental act of February 26, 1859, entitled, “An act to authorize settlers upon sixteenth and thirty-sixth sections, who settled before the surveys of the uublic lands, to preempt their settlements.” This selection was approved by the secretary of the treasury under date of January 27th,…
