Mark Howard commenced this action against his employer, United Parcel Service, Inc. (“UPS”) on July 11, 2012. (ECF No. 1.) Howard has been deaf since birth. He has been employed by. UPS in various capacities since May 1999. He alleges that during the course of his employment, and because of his inability to hear, he was subjected to discrimination in violation of the Americans with Disabilities Act (“ADA”), 42 U.S.C. §§ 12112-17, and the New York State Human Rights Law (“NYSHRL”), N.Y.
