ORDER

OBERDORFER, District Judge.

The Estate of Dr. John A. Jamieson (“the Estate”) moves to reconsider, or in the alternative, to alter or amend, the July 27, 2001 Order which denied its motion for summary judgment. The July 27 Order determined that the question of whether the Estate’s decedent was plaintiffs “employer” within the meaning of the wrongful termination provision of the False Claims Act, 31 U.S.C.A. § 3730(h), was not susceptible to resolution by summary judgment, but turned on an issue of fact to be decided by a trier of fact.
