MEMORANDUM OPINION
LEON, District Judge.
Before the Court are the motions to dismiss of five of the remaining seven defendants in this case, Marsh USA, Inc. (“Marsh”), Chartered Health Plan (“Chartered”), Robert L. Bowles, Healthcare Insurance Services Inc. (“HIS”), and Western Indemnity Insurance Co. (‘Western’’). 1 The plaintiff, John M.
