MARSH, District Judge.

Preston Boyd, the relator, filed a petition in forma pauperis for a writ of habeas corpus. The court issued a rule to show cause why the writ should not be granted and a hearing held as prayed for by relator. At his request counsel was appointed to represent him. Pursuant to order of this court, the District Attorney of Butler County furnished the records of the proceedings involving the relator’s conviction in the Butler County Criminal Court.
