dissenting.—The plaintiff brought this action against one M. E. Pogue and Charles Nickell in the circuit court of Multnomah county, to recover for goods, ware's and merchandise alleged to have been sold by plaintiff’s assignors to the defendants, as partners doing business under the firm name of M. E. Pogue. The venue was changed to Jackson county, on the ground of the convenience of witnesses.
