DURFEE, Senior Judge.

Petitioner-Appellant, Edward James, filed a petition for a writ of habeas corpus in the United States District Court, pursuant to 28 U.S.C. § 2254. On June 8, 1971, the District Court denied the application, and dismissed the petition, but entered an order on June 25, 1971, granting petitioner a certificate of probable cause for appeal from the dismissal. Petitioner now brings this appeal.
