On May 7, 1964, plaintiffs, Henry and Virginia Stella, filed a complaint for rescission of an agreement to purchase real estate, cancellation of a promissory note and trust deed executed in connection with said agreement, and damages for negligence in construction of a house which was the subject of said agreement. Several parties including Great Western Savings & Loan Association (hereinafter referred to as Great Western) were joined as defendants.
