This action was commenced in the District Court of Douglas County, and resulted in a judgment in favor of the defendant in error. On proceedings in error the case was reviewed by the Court of Appeals, and the judgment of the District Court affirmed. Menger v. Carruthers, 3 Kan. App. 75. The *426facts in the case are more fully stated in the opinion there filed, and the questions involved are more fully discussed than is necessary here.
