Plaintiff is the administratrix of the estate of her deceased husband, who was killed while crossing Flushing avenue, Brooklyn, N. Y., on October 12, 1939, at about midnight, when he was struck by a trolley car owned by the defendant and operated by defendant’s employee. Deceased lived in Manhattan and was proceeding in the direction of a station of the subway line which ran to that borough. Shortly before the accident deceased had been standing on the sidewalk of Marcy avenue, near the corner of Flushing avenue, talking to an acquaintance. Apparently deceased was to some degree intoxicated…
