STATEMENT OF THE CASE
On April 26, 1996, Kimberly C. Ackles (“Ackles”), Special Administrator of the Estate of James L. Porter (“Porter”), deceased, initiated a lawsuit against Hartford Underwriters Insurance Corporation (“Hartford”), seeking uninsured motorist coverage for a fatal accident involving Porter and an alleged hit-and-run vehicle. On February 24, 1997, Hartford moved for summary judgment and argued that no “hit and run” vehicle, as that term is defined in the insurance policy, had been involved in the accident.
