This was an action to recover on a policy of insurance and from an adverse judgment the plaintiff appeals.

In the trial court a jury was waived and the cause was submitted on plaintiff’s petition and on stipulated facts. The defendant filed *151no answer, but it was agreed that it denied liability generally. For present purposes it may be said that it was alleged in the petition that on March 5, 1926, Frank S. Kenyon, bom September 6, 1889, procured from the defendant company a policy of insurance on his life for $2,000, the beneficiary being his…
