I. BACKGROUND
Appellants 1 challenge the validity of a Federal Election Commission (FEC) regulation and a derivative advisory opinion, as well as the lawfulness of a contribution solicitation proposed by the Democratic National Committee (DNC). The regulation, 11 C.F.R. § 110.1(g)(1), 2 provides that campaign contributions made for the purpose of retiring campaign debts from elections held before January 1, 1975, 3 are not subject to the contribution limitations of the Federal Election Campaign Act.
