MEMORANDUM OPINION AND DECISION

STEPHEN J. COVEY, Chief Judge.

This matter comes before the Court upon the Motion for Summary Judgment filed by Judi E. Beaumont, Trustee (“Trustee”), for Vogue Coach Company. Granting of this motion is appropriate, if, from the attached affidavits and depositions, there is no dis pute as to the material facts and if the moving party is entitled to a judgment based upon applicable law. Celotex Corp. v. Catrett, 477 U.S. 317, 106 S.Ct. 2548, 91 L.Ed.2d 265 (1986).
