MEMORANDUM OF DECISION AND ORDER

On September 15, 2011, the Plaintiff 82-11 Queens Boulevard Realty Corp. (the “Plaintiff’ or “QBRC”) brought this action against the Defendant Sunoco, Inc. (R & M) (the “Defendant” or “Sunoco”) seeking damages and indemnification under an existing contract entered into between the parties as well as attorney’s fees and expert fees pursuant to the New York Navigation Law.
