Appeal from a judgment of the County Court of Broome County (Smith, J.), rendered January 18, 2012, upon a verdict convicting defendant of the crimes of assault in the first degree and criminal possession of a weapon in the second degree (two counts).
Defendant was indicted for assault in the first degree and two counts of criminal possession of a weapon in the second degree. The charges arose from an early morning incident on August 15, 2010 at an after hours club in the City of Binghamton, Broome County.
