Appeal by the defendant from a judgment of the Supreme Court, Kings County (Marrus, J.), rendered March 20, 1989, convicting him of kidnapping in the second degree, upon a jury verdict, and imposing sentence. By decision and order of this Court dated September 30, 1991, the judgment was reversed and the indictment dismissed (People v Gonzalez, 171 AD2d 127). By decision and order dated October 20, 1992, the Court of Appeals reversed and remitted the matter to this Court for consideration of the "facts and issues raised but not passed upon” (People v Gonzalez, 80 NY2d 146).
