RULING ON PLAINTIFF’S MOTION FOR PRELIMINARY INJUNCTION
ARTERTON, District Judge.
Plaintiff Fernando Castillo brings this action for judicial review of the final determination issued by the Food and Consumer Service 1 (“FCS”) permanently disqualifying plaintiff’s retail food store, El Coqui Grocery Store, from participation in the Food Stamp Program. Pursuant to 7 U.S.C. § 2028(a), plaintiff seeks a preliminary injunction enjoining the federal government from enforcing plaintiff’s disqualification while this review is pending.
