DECISION AND ORDER
LARIMER, Chief Judge.
Plaintiff Saleh Ahmed brings this action pursuant to 7 U.S.C. § 2023(a). Pending before this Court is plaintiffs motion for a preliminary injunction, seeking to enjoin the enforcement of a final determination issued by the United States Department of Agriculture, Food and Nutrition Service1 (“FNS” or “the Agency”) permanently disqualifying his retail food store, Martinez Grocery, from participating in the Food Stamp Program. Plaintiffs motion for a preliminary injunction is granted.2
