Plaintiffs, Battle Creek Health System and Trinity Health-Michigan, filed this action against Tommy G. Thompson, Secretary of the Department of Health and Human Services (“Secretary”), under Title XVIII of the Social Security Act, 42 U.S.C. § 1395 (the “Medicare Act”), and the Administrative Procedure Act, 5 U.S.C. § 551 (the “APA”). This matter is presently before the court on Plaintiffs’ Motion for Summary Judgment (dkt.#23), and Defendant’s Counter-Motion for Summary Judgment (dkt.#27).
