KRUEGER, Judge.

The appellant was tried and convicted of the offense of unlawfully carrying a pistol, and his punishment was assessed at a fine of $250.00.

The testimony adduced by the State shows that on a Sunday afternoon, during the month of April, A. D. 1935, the appellant interested himself in a chicken fight. He brought a rooster, belonging to Phil Marx, to the arena, entered it, and bet some money on the result of the fight. The referee called the fight a draw as both chickens died at the same time.
