MEMORANDUM OPINION AND ORDER
HOLDERMAN, District Judge:
On August 20, 1990 a divided en banc Seventh Circuit affirmed this court’s ruling that Superintendent of Police Fred Rice was not entitled to qualified immunity from suit with regard to the claims presented by plaintiffs in Counts III and V of the Second Amended Complaint. 1 Auriemma v. Rice, 910 F.2d 1449 (7th Cir.1990).
