OPINION

SCHUMACHER, Judge.

Appellant St. Paul Fire & Marine Insurance Company brought this declaratory judgment action seeking a determination whether it was obligated to defend and indemnify its insured, respondent National Computer Systems, Inc. (NCS), as a result of a lawsuit brought against NCS by Boeing Computer Systems. NCS moved for summary judgment, which the trial court denied, determining there were fact issues in dispute. NCS then requested reconsideration, which the trial court granted, determining that the presence of factual disputes required St. Paul Fire to provide a defense.…
