In an action brought by McGregor, in the capacity of receiver of the Bank of Warrenton, against Fitzpatrick, the substance of the petition, as amended and as now material, was: In 1901 the bank held defendant’s note, payable to it, for $6,000. At that time the defendant was the owner of ten shares of the capital stock of the bank, and in addition thereto controlled five shares owned by his wife and five shares owned by his mother-in-law.
