The first relief prayed for in the plaintiff’s complaint is that the Railroad Commission of the *484state of Wisconsin be enjoined from objecting to the granting by the War Department of a permit for the erection of the building in question. This phase of the case did not receive a great deal of consideration. We find no discussion of it in the briefs of counsel for the state. We are referred to no provision of the statutes which makes it the duty of the Railroad Commission to appear before the War Department in cases of this…
