In separate actions, Walter Paclawski and his wife, Elizabeth Paclawski, sued the defendant drug company and its salesman, John Null, for damages resulting from the use by Mrs. Paclawski of a medical preparation called “Kantrex” in 1958. It was alleged that the drug was prescribed and administered by Dr. Downs of the Cooper Clinic in Fort Smith, Arkansas, and that it was developed and placed on the market by the defendant drug company.
