This appeal is from an order of the honorable district court of Archer county overruling a motion to set aside a temporary writ of injunction theretofore issued on an application of appellee, R. A. Brand.

In his verified petition for the writ, Brand alleged that on May 23, 1928, appellant, Ed Friedrich, by his representative J. J. New-som, contracted in writing to sell to plaintiff “one 12 foot Freezerite Freezer Counter for salt and ice.” A copy of the contract was attached to -the petition as an exhibit.
