The defendant was tried on a charge of first degree murder. The jury found him guilty of the crime of manslaughter. He was sentenced to a term of 3 to 8 years imprisonment to run consecutively to a sentence the defendant was then serving.

On April 19, 1973, the defendant was admitted to the Nebraska Penal and Correctional Complex to serve a *622sentence for robbery. Shortly after his arrival, the defendant looked out a window and saw inmate Irvin Cooper standing outside the east cellhouse.
