September 11, 1889, awarding the complainant nothing upon a claim filed pursuant to the act of 1884 (Chap. 318, Laws of 18'84), authorizing said board to hear, determine and audit certain claims of the state against certain counties therein named. By chapter 734 of the Laws of 1872, the state attempted to impose a tax of three and one-half mills per dollar on the assessed valuation of real and personal property in the state. This act was subsequently declared void by the courts on account of remedial defects of form-. In the meanwhile, however, most of the counties of the state had levied and collected the tax and paid the amount thereof into the state treasury.
