RIVES, Circuit Judge:

This is a consolidated appeal from two separate orders of the district court. On October 1, 1973, the district court denied declaratory, injunctive and habeas corpus relief sought by petitioner-appellant Scott prior to a general court-martial convened to try him for alleged violations of the Uniform Code of Military Justice. On February 11, 1974, following petitioner-appellant’s trial and conviction, the district court denied Scott’s petition for habeas corpus relief, and refused to restrain Scott’s transfer from Carswell Air' Force Base in Texas to Fort Leavenworth,…
