This case requires us to determine the meaning of “frivolous” as used in 28 U.S.C. § 1915(d) and whether the district court properly dismissed the plaintiff’s suit as frivolous pursuant to that section. Eugene Malone, a pro se complainant, sued the Greene County, Tennessee Board of Commissioners and Greene County Sheriff Gail Colyer under 42 U.S.C. § 1983 seeking in-junctive and monetary relief.
