Ocwen Loan Servicing, LLC v. Williams

Court of Appeals of Wisconsin

Decided September 27, 2007No. 2007AP260PublishedCited by 5 opinions

1Opinion of the CourtDykman, J.

¶ 1. Patricia Watson appeals from a judgment concluding that Ocwen Loan Servicing, LLC, was entitled to equitable subrogation, thereby making Ocwen's mortgage superior to Watson's lien on real estate owned by Kraig Williams. Watson contends that the trial court erred in applying equitable subrogation to grant priority to Ocwen, and that her lien has priority because it occurred prior in time to Ocwen's mortgage. We conclude that the trial court properly applied the doctrine of equitable subrogation to give priority to Ocwen's mortgage, and therefore affirm.
