Sergio Fraire appeals the trial court’s take-nothing grant of hybrid summary judgment in favor of his former employer, Budget Rent-A-Car of El Paso, Inc. (“Budget”), 1 in a non-subscriber negligence action. In his sole issue on appeal, Fraire contends that the trial court erred in granting summary judgment because he established that Budget breached its duty to warn or instruct him about the risks inherent in repairing a broken lift gate on the back of a large truck.
