This action was commenced by Mary *229E. Bectell against John E. Weller, before a justice of the peace in Jay county, to recover a sum of money alleged to have been had and received by the defendant for the use of the plaintiff.
The cause was tried before the justice upon the issues created by the statute, and resulted in a judgment for the defendant.
