—In an action to recover on a promissory note brought by motion pursuant to CPLR 3213 for summary judgment in lieu of complaint, the plaintiff appeals, *454as limited by his brief, from so much of an order of the Supreme Court, Westchester County (Cowhey, J.), entered September 3, 1999, as denied his motion for summary judgment and, sua sponte, imposed a sanction upon him in the sum of $750.
