CLARK, Circuit Judge.

On April 10, 1935, Lillian Warshawsky filed a voluntary petition in bankruptcy in the United States District Court for the Eastern District of New York. She was adjudicated a bankrupt the same day. On August 15, 1935, the Superintendent of Banks of the State of New York filed a proof of claim on a judgment obtained by him against the bankrupt in 1934 on a stock assessment for a closed bank.
