This is an appeal by Evener Bettger [“Evener”] from an order of the Burleigh County District Court denying his motion to vacate a default judgment.

Martha Bettger [“Martha”] commenced an action on July 6, 1978, for an absolute divorce, in which she requested an equitable division of the personal property between the parties, alimony payments, attorney fees, and the costs of the action.
