Appellant brought this action against the Oregon Moline Plow Company, and E. C. Holt doing business under the name of the Spokane Farm Machinery Company, to recover damages in the sum of $33,937.
The complaint alleged that appellant purchased a tractor from E. C: Holt, doing business as the Spokane Farm Machinery Company, a dealer in tractors, and that he settled for the same by cash and notes.
