MEMORANDUM OPINION AND ORDER
WOODS, District Judge.
The Pleadings. The Arkansas Department of Pollution Control and Ecology and the United States of America on March 4, 1980 filed separate suits against the Vertac Chemical Corporation and Hercules, Inc., both Delaware corporations, in the United States District Court for the Eastern District of Arkansas. The complaint filed by the United States is pursuant to Section 7003 of the Resource Conservation and Recovery Act (RCRA), 42 U.S.C. § 6973, et seq., §§ 302(a), 402, 309(b) and (d) and 504 of the Clean Water Act, 33 U.S.C. §§ 1312(a), 1342,…
