This is an appeal from a judgment and sentence after a verdict of the jury finding the defendant guilty of second degree assault.
July 17, 1948, Robert D. Yoakum and Charles Epling had an altercation in Centraba, with the result that Epling received knife wounds administered by Yoakum. Epling was taken to the hospital and Yoakum disappeared. The following night he was apprehended at the home of his sister.
