This case comes before us upon an appeal from the order of the secretary of revenue suspending the petitioner’s license.
The facts averred in the appeal, and uncontradicted, are that Paul Smith was arrested on the charge of drunken driving and failing to stop and render assistance, and, pending his trial at the September sessions, 1935, his operator’s license was suspended on the ground that *200he had driven a motor vehicle in a reckless manner resulting in an accident; that the finding of the Bureau of Highway Patrol and Safety was contrary to the evidence produced at the hearing;…
